Appraisal right for car damage claims

Beginning January 1, 2026, auto policies with first‑party physical damage coverage must include an appraisal clause. You or the insurer can demand appraisal to settle the car’s actual cash value or amount of loss. Each side must pick a competent, disinterested appraiser within 10 days and notify the other side. Appraisers must each value the car and the loss, make separate findings for each part, exchange reports, and finish in 30 days; if more time is needed, the appraiser explains the reason before day 25 and documents it. If the appraisers do not agree, they choose a disinterested umpire; after 15 days, the Insurance Commissioner identifies one. A decision is binding when any two (both appraisers, or one appraiser and the umpire) agree. You pay your own appraiser, and both sides split the umpire’s cost. The law defines “competent,” “disinterested,” and “umpire,” and lets the Insurance Commissioner set rules.
