Beginning January 1, 2027, landlords in buildings with smart access must give you a plain-language privacy policy at signing or within five days of installation. The policy must say what data is collected and why, how it is secured, how long it is kept, when you will be told about a breach, and how data is deleted or anonymized. Landlords and operators can collect only the minimum data needed for access, like your name, unit, allowed doors, hardware IDs, access credentials, lease dates, and time and method of entry. Biometric data is allowed only if the system uses biometrics. The law also defines what counts as a smart access system so these rules clearly apply.
Beginning January 1, 2027, if your building uses a smart access system, your landlord must offer a non-biometric, non-phone way to enter when you ask. Options can include a physical key, key card, key fob, or manual keypad. You do not have to use a mobile app or give biometric data to get into your home.
