Loans that skip the $80 fee

Some loans are exempt from the $80 foreclosure prevention fee. Reverse mortgages to a borrower age 60 or older do not pay it. Chattel loans and retail installment contracts to buy a dwelling that is personal property do not pay it. If you buy up to a four‑unit home using certain state homeownership programs, the fee can be charged only on the first‑lien mortgage.

New $80 mortgage closing fee

When you close a residential mortgage on property in Washington, you pay an $80 foreclosure prevention fee. The escrow or settlement agent collects it at closing and sends it to the state foreclosure fairness account. You can add the fee to your loan or pay it in cash at closing. The fee must appear in your loan disclosures, but lenders may leave it out of the finance charge/APR. You must get a notice about the fee and its purpose at or before it is charged.

State sets rules to run fee

The state department can set policies and procedures to collect, manage, and enforce the foreclosure prevention fee. It may make remittance agreements with closing agents and adopt rules to carry out the law.
