Cities can skip bids for urgent energy

Until January 1, 2045, a city or town may waive competitive bidding for some energy‑related purchases and common‑facility projects. The governing body must first find the item is proprietary or specialized with no real alternative, is needed to meet reliability standards, or prevents a grid threat. The governing body must record this factual finding before using the waiver.

Faster clean energy purchasing for utilities

Through January 1, 2045, public utility districts and other consumer‑owned utilities must use a contract for covered work over $500,000, excluding sales tax. They may use their own crews without a contract when materials are worth $1,000,000 or less, when this is standard industry practice. By resolution, a commission may use an alternative process for items of the same kind totaling over $50,000 but under $250,000 per month, excluding sales tax, and may waive bid deposits or bonds. These rules apply to nonemitting or renewable power, energy storage, and transmission or distribution projects.

Modernized bidding rules for utilities

Utilities with a purchasing department may accept sealed bids on paper or electronically. Contracts under these rules may be awarded up to 25% above the estimated cost, up from 15%. These changes apply to contracts let under the public utility district bidding statute.
