Study to update e-motorcycle rules

Starting March 23, 2026, the Department of Licensing must form a work group to update electric motorcycle laws. The group includes state and local safety and transportation officials, tribes, and rider and recreation groups. It studies definitions, registration and license fees, driver licensing and age limits, equipment and road rules, and enforcement. It also reviews civil penalties for giving electric motorcycles to kids under 16, deceptive marketing and tampering, and buyer disclosures. An interim report is due December 15, 2026. A final report is due October 31, 2027.

E-bike classes, speed and tampering rules

The law defines electric-assisted bicycles as bikes with two or three wheels, a saddle, pedals, and a motor of 750 watts or less. It creates three classes: Class 1 pedal-assist to 20 mph, Class 2 throttle up to 20 mph, and Class 3 pedal-assist to 28 mph with a speedometer. Bikes that can go over 20 mph on motor power alone are not e-bikes. Bikes designed or sold to be easily reconfigured to break these limits are also not e-bikes. These rules guide riders, sellers, and police on what counts as an e-bike.
