Striking workers: repay unemployment after retro pay

Beginning June 11, 2026, if you got unemployment during a strike and later get retro pay for those same weeks, you must repay those benefits. The department issues an overpayment assessment and recovers the matching amounts under its recovery rules. When you apply for strike-related unemployment, the department must tell you about this risk, online or by letter or another reasonable method. These notice and repayment rules end after December 31, 2035.

Unemployment rules must follow federal law

If any part of this law conflicts with federal rules tied to unemployment funding or employer tax credits, that part does not apply. State rules under this law must meet federal requirements so the state keeps federal funds and employer tax credits.
