Beginning June 11, 2026, certain air quality fees and penalties are deposited in the air pollution control account. The legislature must approve spending from the account. Money can be used only to carry out state air laws, and air toxics fees can be used only for the air toxics program. Ecology shares part of the account with local air authorities, based on local air problems, program costs, and other funding they have.
Beginning June 11, 2026, the Department of Ecology and local air authorities can charge fees to run the state air toxics program. Fees can cover both direct and indirect program costs. Fees the department collects go into the air pollution control account. The department uses them only for the air toxics program. Businesses and facilities covered by the program pay these fees.
Beginning June 11, 2026, the state creates two dedicated accounts for lab accreditation and air permits. Lab accreditation fees go into the lab account. Air operating permit fees go into the permit account. The legislature must approve spending from these accounts. Money can only fund those specific programs.
