Washington’s hazardous substance tax does not apply to certain farm pesticides kept in storage. The product must be solely for use by a farmer or a certified applicator. It must be warehoused in Washington or shipped to or from Washington, and not used, mixed, packaged for sale, or sold in the state. Mixing with other chemicals counts as manufacturing, and moving it between containers or tanks counts as packaging for sale. The product must meet the federal pesticide law definition (FIFRA) as of September 1, 2015. The exemption lasts through January 1, 2038.
