Stronger misclassification checks on public works trades

The Department of Labor and Industries must investigate misclassification on public works when a referral is made and a contractor engages three or more independent contractors doing the same type of covered finishing work at the same time. Covered finishing work means drywall, flooring, tiling, painting, and glazier or glasswork. The awarding public agency, any contractor or subcontractor on the job, a labor union for those trades, or any worker doing the finishing work can make a referral. If misclassification is found, the contractor faces all requirements, liabilities, and penalties under chapter 39.12 RCW, and the department also makes referrals under Titles 50 and 51 RCW. This protects workers and raises compliance and penalty risks for contractors.
