Starting July 1, 2026, employees of the Departments of Health Facilities, Human Services, and Health are no longer in West Virginia’s classified civil service. They also cannot use the state grievance process. If you leave your current job and stay a state employee in a related department named in law, you move to the classified‑exempt system and lose grievance access.
If you are in the classified civil service on July 1, 2026, you keep that status while you stay in the same job. If you already have access to the state grievance process, you keep it as long as you remain in that job.
These departments must still follow state bans on nepotism, favoritism, discrimination, and unethical practices. Jobs appointed by the Governor are not covered by the new exemptions. Department secretaries can change some employees’ status when needed to meet federal law or keep federal funding.
