The DMV can set up or contract for a donor registry and must share donor sign-ups, changes, or removals. The registry lets donors add a statement or symbol on state cards and is open 24/7 so organ recovery teams can check status near death. Your personal donor data stays private and cannot be shared without your consent, except to confirm your choice near death. Private registries must follow the same access and privacy rules.
You can record your donor choice on a driver’s license, state ID, voter card, or hunting/fishing license. You can also use a will, a donor card or registry, or a spoken gift during a terminal illness with two adult witnesses, one disinterested. If you cannot sign, another person may sign for you with two adult witnesses and a note that they witnessed it. Ending or suspending a license or ID does not cancel an earlier gift. The Division of Natural Resources gives organ-donation info to hunting and fishing applicants and sends donor updates to the registry, and the law defines key donation terms.
Voter registration forms now ask, on a voluntary basis, if you want to be an organ donor and join the National Donate Life Registry. Your application cannot be rejected for leaving this question blank. When you register or update your voter record, the Secretary of State provides organ-donation information and sends your donor choice to the donor registry. The Secretary of State proposes rules that set the minimum personal information sent to the national registry.
West Virginia accepts the federal postcard and the FEC mail voter form as valid state registration forms. The state can run secure online voter registration and let clerks use an approved electronic signature on file. All forms must include an eligibility oath and your driver’s license or DMV ID number, or the last four digits of your Social Security number. Paper mail forms are bid statewide every two years, with contracts starting September 1 in odd-numbered years.
The Center for Organ Recovery and Education must repay the Secretary of State and the Division of Natural Resources for costs to run or transmit donor records. If the center does not reimburse, each agency is relieved of collecting and sharing those donor records. This ties some state duties to outside funding.
