Corporate taxpayers, including LLCs taxed as corporations, get a state tax subtraction. They can subtract the net ordinary income from a West Virginia Qualified Opportunity Zone business from West Virginia taxable income. The business must be newly registered in West Virginia on or after January 1, 2019 and before January 1, 2033. It must be a Qualified Opportunity Zone business under federal rules. It cannot be a reorganization of a business that existed before 2019. The subtraction lasts 10 years. It starts with the first full tax year the business first qualifies, or the first year it has net income. It applies to tax years beginning on or after January 1, 2019. It ends for tax years beginning on or after January 1, 2033. If you qualified before it ends, you keep the rest of your 10 years if you stay in compliance. The 2026 amendment grants retroactive entitlement for tax years beginning on or after January 1, 2024. The Tax Commissioner may issue rules to carry this out.
