Start date and rules for Medigap rights

These protections apply to Medigap policies delivered, reissued, or extended in West Virginia on or after June 1, 2026. They also apply later whenever a policy term changes or a premium is adjusted. The Insurance Commissioner may set rules to run the law, like checking eligibility and lining up start dates. The rules cannot expand who qualifies, add benefits, or change rating methods beyond what the law says.

Birthday Medigap switch without underwriting

Beginning June 1, 2026, you can replace your Medigap policy once each year around your birthday without medical underwriting or waiting periods. You must be enrolled on your birthday and have had your current policy for at least 24 months. Apply in a 60‑day window that starts the first day of your birth month. The new policy must have the same or fewer benefits and usually come from the same insurer or an affiliate. You may buy from any WV insurer only if your insurer and its affiliates have not taken applications for that plan type in the last 12 months. The new policy cannot start before the old one ends, and you may ask to delay the start up to 90 days to avoid double premiums.

Medigap access after losing Medicaid

Beginning June 1, 2026, if you are 65 or older, have Medicare, and lose Medicaid, you get a 63‑day window to buy Medigap. Insurers must sell you a policy without medical underwriting or pre‑existing condition waits. You can choose any plan being sold to new customers by any licensed WV insurer. These rights apply no matter your past Medigap history or whether you had Medicaid when you first got Medicare. Leaving a Medicare Advantage plan alone does not trigger this right.
