Criminal penalties for gift card fraud

Beginning June 12, 2026, the law makes stealing, tampering with, or using false pretenses with gift cards a crime. The person must act with intent to defraud. If the value is under $1,000, it is a misdemeanor: up to 1 year in jail and/or up to a $1,000 fine. If the value is over $1,000, it is a felony: 1 to 10 years in prison and/or up to a $2,500 fine. For tampering cases, values from multiple cards can be added together when part of one scheme. The law also defines what counts as a gift card, who is a cardholder or seller, and what redemption information means.
