Discipline rules for multistate licensees

Your home state controls actions against your multistate license. Any remote state can stop you from practicing inside that state. If your home state suspends or encumbers your multistate license, your ability to practice in all member states stops until it is cleared.

Work across states with one license

You can apply for a multistate cosmetology license if you hold an active, unencumbered home-state license. Member states treat that multistate license like their own license, so you can work across compact states. You must follow compact and commission rules. The commission and your home state can charge fees to issue and renew the multistate license.

Rules for states to join or leave

To join the compact, a state must regulate cosmetology, handle complaints, require exams and training, check backgrounds, share discipline data, and follow commission rules. If a state breaks compact rules, the commission notifies it and can end its membership if not fixed. When a state withdraws or is terminated, license recognition continues for at least 180 days.

New multistate cosmetology commission and rules

The law creates a Cosmetology Licensure Compact Commission to run the compact. The commission can make binding rules, hire staff, charge fees, take grants, and enforce the compact. It operates a central database with a unique ID for each applicant; states must send uniform license and discipline data, and expunged records are removed. The commission must give public notice and hearings for rules. It can use emergency rules with five days’ notice but must finish normal rule steps within 90 days.

Privacy for your background check

Background check results are kept private. Only you, someone you authorize in writing, or a court can get them. These records are not public under the state’s public-records law.

Keep home license during military duty

Active-duty service members and spouses can choose a home state where they hold a current, good-standing license. They keep that home-state designation while on active-duty assignment. This helps you maintain your license while you move for service.

Background checks and fingerprints for licenses

To get a West Virginia cosmetology license, you must submit fingerprints for state and FBI checks. You must allow the board, State Police, and FBI to use the records. You must pay the actual costs of fingerprinting and the checks. These rules also apply when you seek your first privilege to practice in another compact state.
