Parolees pay monthly fees, with ability review

Beginning June 8, 2026, parolees pay a monthly supervision fee. The fee is based on ability to pay and cannot be more than $50 per month (up to $600 a year). It also applies to federal or out-of-state probationers and parolees supervised in West Virginia. The Division reviews income, liquid assets, debts, child care and transportation costs, and likely harms from denying a waiver or reduction.

Limits on treatment and day report placements

Beginning June 8, 2026, the Division can require substance abuse treatment only if a standard assessment shows high risk to reoffend and a need for treatment. It can require day report or other community corrections at the start only if the assessment shows moderate to high risk and moderate to high criminogenic need. Any placement needs the center’s consent. Parolees must follow center rules and can be removed by the director.

Where supervision fee money goes

The law creates the Parolee’s Supervision Fee Fund in the State Treasury. Money from supervision fees goes into this fund and can be spent on parole supervision only if the Legislature approves. Extra amounts can be moved only by legislative appropriation. The state also sets a master agreement so counties can be reimbursed for eligible community corrections placements.
