Tax on HMO premiums starts 2027

Beginning July 1, 2027, certified HMOs (managed care plans) pay a 2.5% tax on gross premiums written in West Virginia each quarter. The tax year runs July 1 to June 30. The rate applies to all certified HMOs, but not to Medicare Advantage, PEIA plans, or some federal employee plans if federal law blocks it. The state switches from a member‑month charge to this gross‑premium method and must have federal approval that it is an allowable health care‑related tax for Medicaid funding. The state cannot collect the tax for a year until CMS gives written notice that Medicaid rates for that year are actuarially sound. If CMS later finds the tax is not allowed for federal Medicaid funding, it becomes void automatically. Until July 1, 2027, the prior member‑month rules stay in effect.
