You cannot sue your insurer over a mine subsidence claim that you reported to the board. If the board finds fraud or a policy violation, it can require your insurer to try to get the money back from you; the board pays the recovery costs. The board cannot seek reimbursement from insurers unless the insurer committed fraud.
The board’s reinsurance per structure cannot be more than $200,000 and cannot be more than your fire insurance amount. Money you receive for a covered loss must go first to pay for property damage. If another source pays part of the loss, the fund pays only the rest, up to its limit.
Beginning October 1, 1982, every policy that insures a West Virginia structure includes mine subsidence coverage unless you sign a waiver. In Berkeley, Cabell, Calhoun, Hampshire, Hardy, Jackson, Jefferson, Monroe, Morgan, Pendleton, Pleasants, Ritchie, Roane, Wirt, and Wood counties, you get this coverage only if you ask for it. Coverage added by a new policy or endorsement starts 30 calendar days after you apply. The board sets the price for this coverage, and insurers must use that price. Your deductible must be at least $250 and no more than $500.
