Beginning June 9, 2026, if you are an employee driving a company vehicle for work with permission, your employer’s auto liability insurance is primary. Your own auto insurance is secondary. These rules apply to policies issued or in effect on or after that date.
Beginning June 9, 2026, auto liability policies in West Virginia cannot exclude coverage for guest passengers. Passengers are covered for injuries and damage to their property under the vehicle owner’s liability policy. These rules apply to policies issued or in effect on or after that date.
Beginning June 9, 2026, your own auto policy is primary when you drive a dealer or service replacement car with permission, you did not pay extra at pickup, and your car is in the shop. The business’s policy pays only after your coverage is used up. For vehicles owned by rental, leasing, sales, repair, or service companies, the company’s state-required coverage is secondary to any liability insurance you already have. But if you buy the rental company’s liability coverage for an extra charge, that purchased coverage is primary. These rules apply to policies issued or in effect on or after that date.
