FAA-funded airport projects follow federal procurement

For airport projects that use FAA Airport Improvement or Airport Terminal funds, authorities can use any FAA-approved delivery method, like design-build or construction manager at-risk. The project must meet FAA design and safety standards. Buying and contracting that follow FAA rules count as meeting West Virginia procurement rules.

Airport boards set rules and hire

Airport authorities can adopt bylaws and rules that do not conflict with law. They can elect officers, create committees, hire staff, and set pay. They can delegate duties and decisions to officers, agents, and employees.

Airports can build and lease facilities

Airport authorities can buy and manage property. They can build, expand, and repair airport buildings and related roads and parks. They can lease buildings and sites to tenants on terms they approve. They can contract with public or private partners to develop airports and business parks.

Airport fees, bonds, and borrowing tools

Airport authorities can borrow money and issue revenue bonds. They can set and collect reasonable fees and charges. They can apply for and use grants, donations, and regional help, and spend their funds to carry out projects. Authorities may set how member governments pay through bylaws. These tools can fund projects, but debt may raise fees or rents later.

Airport management deals allowed, powers limited

Airport authorities can sign management agreements with any county, city, or town to run an existing airport. Their other powers apply only in the airport’s county and counties next to it. The law still allows management agreements with noncontiguous local governments.
