State certification for small, women-, minority-owned

The Department of Administration writes rules for a statewide certification program, and the Legislature approves them. The rules set minimum requirements and how to review local, state, federal, or private certifications. If you already have a qualifying outside certification, the state accepts it with no extra paperwork or new fee. The law takes effect 90 days after passage.

Who qualifies as small, women- or minority-owned

The law defines a small business as independently owned, with 250 or fewer employees with affiliates, or average yearly gross receipts of $10,000,000 or less over the last three years. Women- or minority-owned firms must be at least 51% owned and have daily management controlled by those owners. A minority individual includes African American, Asian American, Hispanic American, or Native American citizens, and noncitizens who follow U.S. immigration law. “State agency” means units of state government, not counties or cities.

Reciprocity rule for out-of-state vendors

Vendors from states that refuse similar certifications to West Virginia firms, or give in-state preferences WV firms do not get, are denied WV certification. This protects access for West Virginia small, women-, and minority-owned businesses.
