Deposits, spending, and caps for Court Security Fund

The Supreme Court of Appeals now manages a Court Security Fund in the State Treasury. Magistrate and circuit court clerks must send all court-security fees by the 10th day of each month. The fund can also take gifts, grants, and donations that are marked for it. Money is used only for approved court security plans and to run the fund, and only when the Legislature appropriates it. Admin costs are capped at the lesser of 3% of yearly deposits or $30,000. If the fund has more than needed, the Legislature can move the surplus to other accounts. When directed in an appropriation act, the board transfers money to the Domestic Violence Legal Services Fund for its set purposes.

New Court Security Board and bailiff list

The law creates a Court Security Board to decide how fund money is used. The board has six voting members plus the Supreme Court’s administrative director as chair. Members serve four-year terms and may not serve more than three in a row. The board must keep a list of certified, firearms-qualified officers who can work as bailiffs. County sheriffs use this list to hire temporary, part-time, or occasional bailiffs.
