Title 10 › Subtitle Subtitle A— - General Military Law › Part PART II— - PERSONNEL › Chapter CHAPTER 58— - BENEFITS AND SERVICES FOR MEMBERS BEING SEPARATED OR RECENTLY SEPARATED › § 1150
Veterans who left the armed forces between October 1, 1990, and December 31, 2001, and who apply to join a National Guard or Reserve unit within one year after leaving must be given priority over other equally qualified applicants for open or planned spots in that unit. Under rules the Secretary of Defense makes, those veterans may stay in the unit for up to three years even if the unit is at its normal size limit, as long as they keep good standing. The same rules apply to the Coast Guard, and the Secretary of Homeland Security must make the Coast Guard rules when it is not part of the Navy.
