Title 10 › Subtitle Subtitle E— - Reserve Components › Part PART II— - PERSONNEL GENERALLY › Chapter CHAPTER 1205— - APPOINTMENT OF RESERVE OFFICERS › § 12211
When an Army National Guard officer gets federal recognition, they must be made a Reserve in the Army National Guard of the United States at the same rank. An Army Reserve who is federally recognized as a Guard officer becomes an officer of the Army National Guard of the United States and stops being in the Army Reserve. If recognition was temporary, the Reserve appointment is effective from that temporary date. If the Guard is ordered to active duty, the President may appoint any Guard officer who is not already a Reserve as a Reserve at their current rank.
