The Secretary can buy group insurance from private companies instead of, or along with, using the Fund to provide the required benefits. The Secretary can skip normal competition rules to make such a purchase. To sell a policy, a company must be licensed to sell insurance in all 50 States and in the District of Columbia and, as of the most recent December 31 for which the Secretary has data, must have at least one percent of the total amount of insurance in force in the United States. Any company that issues a policy must set up an administrative office where the Secretary says and under the name the Secretary picks. The Secretary may use the company’s services, pick one company to act for the others and pay a reasonable fee, arrange approved reinsurance with other qualified companies, and end any purchased policy at any time.
