If a reservist is on active duty (not for training) and is within two years of qualifying for military retired or retainer pay, they cannot be forced off that active duty before they become eligible for that pay unless the Secretary in charge agrees. If the active-duty order is for less than 180 days, the Secretary in charge can require the reservist to waive that protection for the short tour. The waiver can be required to be signed before the duty starts.
