Title 10 › Subtitle Subtitle E— - Reserve Components › Part PART II— - PERSONNEL GENERALLY › Chapter CHAPTER 1223— - RETIRED PAY FOR NON-REGULAR SERVICE › § 12738
Once someone has been granted retired pay or told they have the required years of service, their right to that pay cannot be taken away just because of mistakes in counting or recording those years, unless the person lied or committed fraud. If the number of years is later fixed, their pay is changed to match the corrected years and they get that pay from the date they were first granted retired pay.
