When an Army or Air Force reserve general on the active reserve list stops holding a job that matches their general rank, the Secretary must, within 30 days, carry out the officer’s choice from four options: move the officer in grade to the Retired Reserve if the officer is qualified and asks; move the officer in grade to the inactive Standby Reserve if qualified; discharge the officer and, if qualified and asks, reappoint them to the reserve rank they had before becoming a general; or simply discharge the officer. If the officer is leaving a joint or other non-joint active-duty assignment, the Secretary has up to 60 days instead of 30. If a National Guard officer had federal recognition only because they served as a State adjutant general or assistant and they leave that job, the Secretary must withdraw federal recognition within 30 days and require one of three outcomes: transfer to the Retired Reserve if qualified and asked for; discharge and, if qualified and asked, reappoint to the prior reserve grade; or discharge. If an officer is reappointed to a lower reserve grade under these rules, they get credit for time in that grade equal to their earlier active-duty service time in that grade and any higher grade.
