Summary

Starting October 1, 2008, if someone picks an annuity that cuts their retired or retainer pay, the pay cut must stop after the later of two things: the 360th month their pay has been reduced because of that annuity, or the month they turn 70 years old. No reductions can be made for any months after that point.

Effective October 1, 2008, a reduction under this subchapter in the retired or retainer pay of a person electing an annuity under this subchapter may not be made for any month after the later of— (1)
(2)the month during which that person attains 70 years of age.
