Title 10 › Subtitle Subtitle E— - Reserve Components › Part PART III— - PROMOTION AND RETENTION OF OFFICERS ON THE RESERVE ACTIVE-STATUS LIST › Chapter CHAPTER 1407— - FAILURE OF SELECTION FOR PROMOTION AND INVOLUNTARY SEPARATION › § 14511
Reserve reserve officers at certain high ranks must leave service on the last day of the month they turn 64 unless they retire, move to the Retired Reserve, or are discharged earlier. This covers Army, Air Force, and Marine Corps reserve officers at the rank of major general or higher, and Navy reserve officers at the rank of rear admiral or higher. Officers at the next higher ranks (Army/Air Force/Marine Corps lieutenant general or general; Navy vice admiral or admiral) can have that separation delayed. The President can delay it only until the first day of the month after the officer turns 68. The Secretary of Defense can delay it only until the first day of the month after the officer turns 66. The rule does not apply to officers covered by a different law.
