Title 10 › Subtitle Subtitle A— - General Military Law › Part PART II— - PERSONNEL › Chapter CHAPTER 76— - MISSING PERSONS › § 1511
If a person who was listed as missing or declared dead under certain federal rules is later found alive and returned to U.S. control, they must get pay for the whole time they were gone, following the rules for pay when someone returns from missing status. People later found to have been absent without leave (AWOL) or deserters are not covered. This does not cancel any death gratuity or other payment already paid for that person before February 10, 1996.
