The Secretary of Defense may give or transfer ownership of equipment that monitors nuclear explosions, and related gear, to a foreign government. The Secretary may also put that gear on foreign land or in international waters and may inspect, test, maintain, repair, or replace it. The gear can only be provided under a written agreement in which the foreign country agrees to give the United States timely access to the data the gear makes and to let U.S. personnel inspect, test, maintain, repair, or replace the gear, including letting them onto the site. Right away after making any such agreement, the Secretary must send Congress a report naming the country, the expected U.S. costs under the agreement, and the U.S. national interest served. The Secretary may delegate this authority only to the Secretary of the Air Force, who may redelegate it.
