The Secretary of Defense may add a price adjustment or surcharge to goods and services sold in commissary stores. Money from those charges can only be used to buy, build, change, enlarge, fix, maintain, or equip commissary stores and central product processing facilities, and to pay for environmental reviews and construction-related planning and overhead. The term “physical infrastructure” means land, utilities, and equipment (including computers) needed for a usable store or processing facility. With the approval of the Director of the Office of Management and Budget, the Secretary can commit expected surcharge money now, even if it crosses fiscal years. The Secretary may also let a nonappropriated fund instrumentality contract for a mall-like project and pay or reimburse the commissary share. Money from recyclables, surplus sales, license fees, royalties, and business-related management fees can be used the same way.
