A military department may advance up to $100,000 to a person hurt, killed, or whose property was damaged or lost when the Secretary could allow a claim. The payment can be made before a claim is filed or before the claim is finally settled. These advances only apply to payments that could be paid under 10 U.S.C. 2733 or 2734 or 32 U.S.C. 715. The Secretary can let the Judge Advocate General make these payments, and can let other officers do so only for amounts up to $25,000. The Secretary must make rules for the payments and try to keep those rules the same across the military departments. Any advance will be subtracted from any later payment awarded for the same injury, damage, or death. Giving an advance does not mean the United States admits it was at fault.
