Summary

A military department Secretary may lease military family housing in the National Capital Region to the Secretary of Defense. When picking a unit, the Defense Secretary should first use any housing already set up for executive communications and security. The lease must charge 105 percent of the monthly basic allowance for housing under section 403(b) of title 37 for a member in pay grade O–10 with dependents at that installation; that amount is treated as the fair market value. Money from those leases must go into a special Treasury account for the military department. Those funds are available, without further appropriation, to maintain, protect, change, repair, improve, or restore military housing on the installation where the leased unit is located.
