The Secretary in charge may sell or lease property or facilities to eligible groups so the money from the sale or lease can fund programs under this part of the law. This does not apply to property on or near a base approved for closure. The Secretary must set the timing, method, and terms so any later sale or lease allows fair competition that fits the value of the property. The Secretary can require prices and other terms that protect U.S. interests. As part or all of the payment, the buyer or lessee must agree to give a suitable preference to service members and their dependents for renting some housing units or other suitable housing. These sales or leases are not subject to certain other federal property and procurement laws, including 10 U.S.C. 2667, parts of title 40 and parts of title 41 (division C with some exceptions), section 1302 of title 40, and section 501 of the McKinney-Vento Homeless Assistance Act. The Secretary must give the congressional defense committees a written notice and a briefing when negotiating to extend a ground lease and before actually extending it. The notice must come no later than 60 days after starting negotiations and the briefing no later than 90 days before extension. The briefing must describe any material differences from the original lease (including new term length and new provisions), say how many housing units or facilities will be built, demolished, or renovated, list any new financing sources, show annual data for the past five years on debt-to-net operating income ratios, occupancy rates, and maintenance response and completion for the housing, provide similar financial and occupancy data for other projects run by the same company, and assess the lessor’s compliance with the Military Housing Privatization Initiative Tenant Bill of Rights (section 2890).
