The Secretary of Defense must appoint an Executive Director for the Council after consulting the Secretary of Energy. Under the Secretary of Defense’s authority, the Executive Director runs the Strategic Environmental Research and Development Program and follows the policies set by the Council. The Executive Director can make contracts using competitive methods and can make other agreements allowed by law. Any contract or agreement that is $500,000 or more (or a lower amount the Council sets) must be approved by the Council first. With the Council’s agreement, the Executive Director can hire the professional and clerical staff needed and, also with the Council’s agreement, set basic pay rates for professional, scientific, and technical employees hired this way without following chapter 51 of title 5 and subchapter III of chapter 53 of title 5.
