Defines when a contractor is a "covered Government support contractor" and what that contractor must do. It means a company hired mainly to give the government independent, unbiased advice or technical help to manage or oversee a program, not to make the program’s products or deliver its services. The company must not be linked to the prime contractor, a first-tier subcontractor, or their direct competitors. The company must sign a contract saying it will only use confidential technical data for the stated purpose, sign a nondisclosure agreement with the data owner, protect the data while the government cannot share it, accept legal penalties for breaches (including criminal, civil, administrative, and contract claims by the United States and civil claims by the data owner), and not use the data to compete against the data owner. The terms "major system component," "modular system interface," and "modular open system approach" are defined in section 4401 of this title.
