The Under Secretary of Defense for Acquisition and Sustainment must make sure each covered DoD contract includes a clause that tells the contractor that taking the work could make the business too large to meet small-business size rules and that the business might lose small-business status. The clause also asks the contractor to work on the skills and features needed to compete as a larger, other-than-small business. Covered small businesses can get help through procurement technical assistance under this chapter. Covered contract: a DoD contract awarded to a qualifying small business that will have annual value above the industry's receipts-based small-business limit, or above $70,000,000 if the industry uses an employee-based size standard. Covered small business: a qualifying small business that has a DoD contract with the required clause.
