The President must send Congress a written notice before deciding to reduce, combine, or remove U.S. nuclear forces that are based in Europe. The notice must say why the change is needed and must include how NATO countries view the United States’ deterrent and its commitments under Article 5 of the North Atlantic Treaty (signed April 4, 1949; in force August 24, 1949). The notice must be sent at least 120 days before the President begins the change. That 120-day rule does not apply if the change is needed to ensure the safety, security, reliability, or credibility of the weapons. “Appropriate congressional committees” means the House and Senate Armed Services Committees and the House Foreign Affairs and Senate Foreign Relations Committees.
