Summary

Within 30 days after the National Defense Authorization Act for Fiscal Year 2024 becomes law, the Secretary of Defense must create an Electromagnetic Spectrum Enterprise Operational Lead for Joint Electromagnetic Spectrum Operations at U.S. Strategic Command. That operational lead will report to the Commander of U.S. Strategic Command. The lead must coordinate and assess how ready the combatant commands are to run joint electromagnetic spectrum operations, give recommendations to the Chairman of the Joint Chiefs, and evaluate tactics, techniques, and procedures for dynamic spectrum sharing technologies. When the President’s budget is sent to Congress for each fiscal year 2025 through 2029, the Chairman, through the operational lead, must brief the congressional defense committees on progress toward full capability, any problems or readiness gaps, recommendations to fix them, gaps in evaluation methods for future dynamic spectrum sharing, the idea of virtual test ranges, and other important related matters.

(a)Not later than 30 days after the date of the enactment of the National Defense Authorization Act for Fiscal Year 2024, the Secretary of Defense shall establish an Electromagnetic Spectrum Enterprise Operational Lead for Joint Electromagnetic Spectrum Operations (in this section referred to as the “operational lead”) at the United States Strategic Command. The operational lead shall report to the Commander of the United States Strategic Command.
(b)The operational lead shall be responsible for—
(1)synchronizing, assessing, and making recommendations to the Chairman of the Joint Chiefs of Staff with respect to the readiness of the combatant commands to conduct joint electromagnetic spectrum operations; and
(2)the evaluation of tactics, techniques, and procedures for dynamic spectrum sharing technologies for joint electromagnetic operations.
(c)Concurrent with the submission of the budget of the President to Congress under section 1105(a) of title 31 for each of fiscal years 2025 through 2029, the Chairman, acting through the operational lead, shall provide to the congressional defense committees a briefing on the following:
(1)Progress made in achieving full operational capability to conduct joint electromagnetic spectrum operations and any impediments to achieving such capability.
(2)The readiness of the combatant commands to conduct such operations.
(3)Recommendations for overcoming any deficiencies in the readiness of the combatant commands to conduct such operations and any material gaps contributing to such deficiencies.
(4)An assessment of any current gaps in evaluation mechanisms for future joint use of dynamic spectrum sharing technologies.
(5)The feasibility and advisability of establishing designated virtual ranges for the evaluation of tactics, techniques, and procedures for dynamic spectrum sharing technologies.
(6)Such other matters as the Chairman considers important to ensuring that the combatant commands are capable of conducting such operations.
