Before asking Congress for money to build a Department of Energy project that supports national security, the Secretary of Energy must finish a conceptual design for the project. If finishing that design will cost more than $5,000,000, the Secretary must first ask Congress for funds for the design before asking for construction money. The design rule does not apply if the project is smaller than the minor construction threshold or if it is emergency work under section 6278. The Secretary may pay for construction design work, including architectural and engineering services, from DOE national security funds if the design will cost $5,000,000 or less. If the design will cost more than $5,000,000, the funds must be specifically authorized by law.
