Title 10 › Subtitle Subtitle A— - General Military Law › Part PART II— - PERSONNEL › Chapter CHAPTER 36— - PROMOTION, SEPARATION, AND INVOLUNTARY RETIREMENT OF OFFICERS ON THE ACTIVE-DUTY LIST › Subchapter SUBCHAPTER V— - ADDITIONAL PROVISIONS RELATING TO PROMOTION, SEPARATION, AND RETIREMENT › § 647
The head of a military branch can, to reshape that service, either discharge certain officers or move them from active duty into a reserve active-status list. This power applies to officers (not including Space Force) who have six years or less as an officer, or who have more than six years but still owe required active-duty service. If a Regular Army, Air Force, Navy, or Marine Corps officer is moved to a reserve active-status list, they leave the regular force and become a reserve commissioned officer. The branch head must write rules on how to use this authority. Space Force officers are handled by a separate rule.
