A military magistrate must be a commissioned officer who is allowed to practice law in a federal court or in the highest court of a State. The Judge Advocate General of the officer’s service must certify that the officer is qualified based on education, training, experience, and judicial temperament. Under rules set by the appropriate Secretary, a military magistrate can also be given other nonjudicial duties, in addition to any duties they have when named under articles 19 or 30a.
