Navy and Marine officers who are permanent professors at the Naval Academy must be retired if they reach 28 years of active commissioned service (for commanders and lieutenant colonels not selected for promotion to captain or colonel) or 30 years (for captains and colonels not selected for promotion to rear admiral (lower half) or brigadier general). The retirement takes effect on the first day of the month after they complete the required years, unless they already left service. The Secretary of the Navy may delay that retirement and keep the officer on active duty and decides how long the delay lasts, but must follow section 1252. If a commander or lieutenant colonel is kept on active duty, they can still be considered for promotion to captain or colonel. When retired, the officer gets the rank set under section 1370 unless entitled to a higher grade, and their retired pay is figured under section 8333.
