Civilian employees with at least five years of service who become completely unable to do their job because of disease or injury before age 65 can be retired and given a lifetime annuity if they apply or the Secretary of the Navy asks for it. The Navy pays each year the difference between the full annuity calculated under section 8585 and the immediate life annuity the person gets from the annuity policy required by section 8582. A medical board chosen by the Naval Academy or Naval Postgraduate School must examine the retiree one year after retirement and each year until age 65 unless the disability is permanent. Payments stop if the person is found able to return to their old job and is offered it, or if they are reemployed by the United States. If they later work again as a civilian teacher at the Naval Academy or Postgraduate School, upon their next retirement the Secretary will pay the difference between the amount under section 8585 and the life annuity their paid premiums would buy. No one may get payments under this chapter and workers’ compensation under chapter 81 of title 5 for the same period.
