A court can give prize property to a claimant on an agreement, a deposit, or other security if four things happen: the claimant proves the item has special personal value beyond market price; the court finds the United States and other claimants won’t be harmed; the U.S. attorney and the naval prize commissioner (or naval special prize commissioner) get a chance to be heard about who will appraise it; and a satisfactory appraisal is made. Money taken under such an agreement or deposited instead of it that is not for costs must be turned over to the Treasurer of the United States or a public depositary the same way sale proceeds are handled.
