Title 10 › Subtitle Subtitle C— - Navy and Marine Corps › Part PART IV— - GENERAL ADMINISTRATION › Chapter CHAPTER 883— - PRIZE › § 8865
The court must order a sale of prize property when one of three things is true: the property has been condemned; the court finds at any time that the property is perishable, likely to deteriorate, or likely to lose value; or the cost of keeping the property is too high compared with its value. The court may order a sale if, after the return-day on the libel, all the parties in interest who have appeared agree to it. An appeal does not stop the sale order or its carrying out.
