When the United States retakes a ship or other property that an enemy had seized, a court must award a salvage payment if the enemy had not officially kept the property before it was retaken. If the property belongs to the United States, it goes back to the government and any court-ordered costs come from the Treasury. If it belongs to a person protected by the United States, the owner gets it back after claiming it and paying the salvage and costs the court sets. If it belongs to someone living under a friendly foreign government, the court follows that government’s usual rules for similar cases; if those rules are not known, the owner must pay the salvage and costs the court orders. Any salvage money awarded must be paid to the United States.
