If a loss is covered by defense-related aviation insurance, the Secretary of Defense must quickly pay the Secretary of Transportation the amount due under the indemnity agreement between them. For a claim for the loss of an aircraft hull, payment must be made within 30 days after the Secretary of Transportation decides the claim is payable or that the policy owes money. For any other claim, payment must be made within 180 days after that decision. While a hull claim is pending, the Secretary of Transportation may make required periodic payments the insured owes to a lessor or mortgagee, starting no later than 30 days after the claim is presented. If the claim is later found payable, those payments are credited against the insurance payout. If the claim is denied, those payments become a debt to the United States and must be returned to the insurance fund or account used. The Secretary of Defense may use Department of Defense operation and maintenance funds to make these payments and may transfer needed sums to the Secretary of Transportation. If a covered loss is or is expected to be more than $10,000,000, the Secretary of Defense must notify Congress as soon as possible and no later than 30 days after the loss. These payments do not require advance congressional notice that other laws might demand, and claims do not have to be combined before payment. Defense-related aviation insurance means the no-premium aviation insurance the Secretary of Transportation provides at the request of the Secretary of Defense under chapter 443 of title 49 and covered by an indemnity agreement. Loss means damage or destruction of property, injury or death, and other covered liabilities and costs.
